Definition of Easement



Literally, the word easement means to feel comfortable. Whereas if it is explained in legal terms, the word easement used in a sense that one has a comfort rather legal right to use other persons’ land and this right of use is just for the cause of any specified purpose.

 


This purpose is not to be used as a trespasser rather for any purpose which leads to performing goodwill among them.

Easement lies under the property law because it is a matter of passing or going in someone’s property for any specified purpose.

 


If we take an example, one person who is a dacoit and living in a specified area. The police came to that area for investigation purpose i.e. the specified purpose. That is not meant as that police has trespassed but police came and use the area as they have the right to investigate.
