Definition of Joint And Several Liability



This is the legal term used when two parties are there and one party sue them due to joint responsibility. The other guilty party has the option to sue the lawsuit and can get the total damages or compensation by the court from any one or all of them.

 


Joint and several liability means that the responsibility is on a party or both parties and can ask for damages from the court. It is said that both parties are liable jointly.

For example, two drunk people in the pub are out of their control and therefore one of them shoots the person in the pub. Hence both drunk persons would likely be held joint and several liability for shooting the person dead because both of their actions cause the innocent person dead.
